3
Identifying The Right Administrator
The person who applies to administer an estate must have the appropriate connection to the deceased and the estate. We advise potential applicants about their position, the information required and any issues that may affect the application.

Administration With The Will Annexed
Sometimes a person leaves a Will but there is no executor available to apply for Probate. Understanding Letters Of Administration In NSW
Letters of Administration are a court grant that allows an administrator to manage and distribute a deceased person’s assets. The grant may be required where the deceased died without a valid Will, or where a Will exists but no executor is available to apply for Probate.
When There Is No Valid Will
A person who dies without a valid Will is generally described as having died intestate, and the estate is distributed under the applicable intestacy rules. The appropriate person may need to apply for Letters of Administration before banks and other asset holders will release or transfer estate assets.
When A Will Exists But No Executor Can Act
A Will may exist, but the named executor may have died, lost capacity, refused to act or otherwise be unable to apply for Probate. In those circumstances, an eligible person may need to apply for Letters of Administration with the Will annexed.
